In Which Nancy Grace Learns that Vaccines Bear No Product Liability in Traditional Court

Surely you're familiar with Nancy Grace, the attorney from Headline News who helps provide publicity and one would hope justice for the underdog. Imagine our surprise (and hers) when Rebecca Estepp educated her on vaccination injury liability and the lack thereof.  Another informative national TV appearance that moved the ball down the field by Rebecca.   Let's continue to educate Ms. Grace on the inequities of vaccine law. She could become a strong ally.

In most cases, families who have a member suffer from a vaccine injury do not learn that their right to civil action against those who made and delivered the vaccine have been removed until after they become victims of vaccine injury. 

It is facinating to see a nationally known journalist/lawyer, who focuses of victims rights, learn that fact on air in the middle of an interview from one of the people she is interviewing. In this case it was Nancy Grace who was taken aback to learn from Health Choice Communications Director Rebecca Estepp, that once a family has a vaccine injured child, their only recourse is to file a claim with Vaccine Injury Compensation Program (VICP) . These VICP claims are unsuccessful four out of five times. Which leaves parents learning the hard way that they are "on their own" when it comes to caring for vaccine injured children.

You are NOT well aware about how the media works on Television. Nancy Grace and Rebecca did exactly what they should. By line two of what you wanted to say, people would have changed the channel..


Linda1, I agree with you, I thought the segment was very effective. Nancy Grace is not someone who gets messed with. In fact I see her as the kind of person who, like Attkisson, would go rogue and do something independent rather than be told what she can do at her job. That lady loves justice so I'm glad if she's in our corner.


Agree. But Nancy verified via the lawyers what Becky was saying. That gave it more impact than if Becky's testimony were to stand on it's own. And, Becky was able to get in the fact that over 800 flu vax injury cases for this supposedly rare adverse effect have been compensated by the VICP AND Nancy brought out the fact that this program functions in the shadows, that JDs and the public are unaware that it exists. The psychologist was ridiculous and the MD was shaky and obviously trying to hedge. For the short time allotted, I think a lot was accomplished. I also think that it was no mistake either. The more I think about it, the more I think that Nancy Grace and crew knew exactly what that segment would report.


uncontrollable muscle movements is a symptom of ADEM..remember Desiree Jennings? she had uncontrollable spasms after the flu shot she got help from a Dr. Buttar in Atlanta. I wonder if he could help this little girl too.


Becky makes a good point about there have not been research on documented cases of serious adverse reaction to flu shots. why isn't anyone following up on these cases???

Unfortunately, while Nancy is justifiably proud of her prior career as a prosecuting attorney in criminal law ... her training as a prosectuor in criminal law .. does not translate well to her new career .. as a "host of a national television show".

Which is why it was infuriating watching Nancy "cross-examine" her "guests" as if they were "witnesses" in a court room .. by demanding "yes" or "no" answers .. to questions that are impossible to answer as "concisely" as Nancy demanded they be in a court of law.

Common sense suggests Nancy .. who admitted having absolutely no knowledge of the Vaccine Court .. should have used this opportunity for herself and her national television audience to "learn" from her "guests" .. just how difficult it is to seek justice for a child injured by a vaccine.

Instead of "unleashing the lawyers" .. Nancy should have let her more knowledgeable "guests" respond in greater detail.

Having said that .. I greatly appreciated Nancy giving attention to this subject on her show .. that in itself required remarkable courage.

We shall see the consequences ...

About half of the flu brands make a thimerosal-free, single-dose version, injectable but, since it's just for one use, it doesn't need mercury as a preservative. A few companies make only thimersoal-free flu vaccines. And Flumist is different, inhaled, and live.


I'm well aware of how Grace interviews or as you say cross examines but anyone being interviewed by the media should know they are in Lions Den and should be prepared to get as much information in as possible. Vaccine opposition is a volatile and contentious subject. I don't believe passivity is an option when being questioned or interviewed. Assertiveness goes a long way in instilling confidence in others who are viewing the exchange. Have facts and data to support your position. Since she knew this was an exchange on the Flu shot IMHO she could have done better. For one, correcting Benowitz's explanation of why Congress gave the vaccine makers blanket immunity. Next stating the Cochrane's Collaborations report on the Flu vaccines. If time permitted tell them about the pack insert that describes all the adverse side effects including the fact the flu shot doesn't stop you from catching the flu. Also, GBS is stated on the vaccine vial insert as a side effect and it's not rare. It is the most compensated vaccine injury.

Suggesting people go to a website is not going to get the information out. Estepp allowed pro-vaccine apologist to control the flow of information which is never a good thing. Grace's shock that the vaccine makers can't be sued is not going to generate much momentum. Other information about the Flu shot's dangerous adverse reactions would have. IMHO.


What is that necklace wear of that there medical professional??? She just come striaght from her life saving work to do that interview or does she just doctor all the time every one she meets and she be a needing that steroscope to listen to Nancy Grace right away????

I guess I'm the odd one out here. I wasn't impressed at all. This was an opportunity for Rebecca Estepp to state a couple of know facts about the Flu vaccines:

-The only flu shot/vaccine that doesn't contain thimerosal is the FluMist. Otherwise in the shots there are 25mcg of thimerosal in each injection. One dose of thimerosal exceeds the EPA’s safety limit of mercury exposure by over 250 times.

-"There are no randomized controlled trials showing efficacy of TIV (the inactive flu virus) in people aged 2-17 years or adults aged 65 and older. For LAIV (the live flu virus), there are no randomized controlled trials showing efficacy in people aged 8-59." *Osterholm, M. et al (2012). Lancet Infect Dis 12: 36-44

-GBS is rare although not that rare after a Flu Vaccine. It seems to be the most compensated vaccine injury by the vaccine court.

Influenza vaccines have a modest effect in reducing influenza symptoms and working days lost. There is no evidence that they affect complications, such as pneumonia, or transmission.

This review includes 15 out of 36 trials funded by industry (four had no funding declaration). An earlier systematic review of 274 influenza vaccine studies published up to 2007 found industry funded studies were published in more prestigious journals and cited more than other studies independently from methodological quality and size. Studies funded from public sources were significantly less likely to report conclusions favorable to the vaccines. The review showed that reliable evidence on influenza vaccines is thin but there is evidence of widespread manipulation of conclusions and spurious notoriety of the studies. The content and conclusions of this review should be interpreted in light of this finding.

Since the vaccines seem to be one size fits all this information applies to children as well as adults.

One important point most people don't realize about the flu shots is in small print on the vial package insert it states that the vaccine doesn't prevent a person from catching the flu it minimizes its symptoms if they do catch it.

Rebecca Estepp also should have given the history of how the NVIC program began. David Benowitz's explanation of why Congress gave the vaccine makers blanket immunity made it sound like a noble cause for the benefit of the country when that characterization is furthest from the truth.


Can't listen anymore to those creepy lobbyists and govt vaccine criminals responsible for poisoning and maiming 60% of US children. They effectively destroyed the US. They all should rot in prisons for life.


There is no such thing as a "Flu shot commercial." If there was / they would have to provide some of the well known side effects.

The flu shot is promoted for a unknown fee by the entire news media every time they say the words "flu shot" / which is about every other day on many local news programs this time of year.

Those repeated images of the permanently disabled little girl and close ups of the flu shot, while the doctors and attorneys waffled on about how maybe it wasn't related and how "rare" it was without acknowledging the suffering of the little girl at all, really put things in perspective.

They say a picture is worth a thousand words..

I wonder if the doctors/attorneys realize just how bad they looked...

Great moment. The first doctor made a fool out of herself with the "temporal association" that occurs in 5% of ADEM. Then Rebecca nailed her.

My question: What sh*tstorm did Nancy Grace and her producers get after the segment? Will Nancy Grace ever be allowed to cover this issue again without following Party line?


Notice the facial/body affect on Dr. Amy Edwards. She seems uncomfortable (and maybe that's normal being on world-wide television?) but it's also the familiar skewed dynamic of "Professional" vs.'mere parents'. Becky was stellar, as always. Too little weight and not enough time.

I hope Nancy Grace doesn't get muzzled, like so many before her.


Eventually, Dr.s like Amy Edwards and the older psychologists will just be afraid of lying and pretending they don't know what the hell happens with situations like this. It makes them look stupid as well as dishonest- not good qualities in a doc.


Ya, it's like when I read up on the issue of vaccines and basically found out that they don't do very much in the way of physiological testing, fake "placebo" comparisons and just shit epidemiological studies. That was a real shocker for me as a parent. Oh, and then how they treat parents in hospitals (Justina Pelletier etc.) and in court. On top of it all, the media lies about it and doesnt even report on it, such as is the case with the CDC Whistleblower- you can only really read about it on alternative mews sites. Very eye opening in a bad way.

Nancy was great, and she admitted to spreading out her children's vaccines rather than follow the recommended vaccine schedule. Nancy put it out there for millions of her viewers that no one can sue a vaccine manufacturer for a devastating, life-altering, vaccine injury caused by their product. How many people found out about the vaccine court for the very first time?

Rebecca was brilliant in her short time on air. That goes without saying. Becky rocks!

Then, there was the priceless "slip of the tongue" at around the 5 minute mark made by Attorney Diana Aizman, when she said something like, "they don't want to discourage vaccine manufacturers from making these vaccines that overall have, you know, a benefit for THE GOVERNMENT--uh for the public." Does it get much better than that?


4 out of 5 do not win.

I have looked and looked for this information and just so bad wanted to know 30 years ago - 20 years ago - 10 years ago.

Did not know that -- but did know it was impossible to even get your case presented to the court to begin with. Impossible.
