Whom Does the Childhood Vaccine Injury Act Protect?

The laws of a country are, generally, designed to protect its citizens. How this ideal is interpreted is a topic of debate in various circles, but its goal is lofty, if not quite perfect. Of specific necessity are laws aimed at protecting children, including child abuse, welfare, and labor laws. Of zero necessity, in my view, is the National Childhood Vaccine Injury Act (NCVIA), which sounds like it has the best interests of this nation’s young citizens in mind, but actually serves a much different purpose.

Congress passed the NCVIA in 1986, and President Ronald Reagan signed it into law soon after. Taken at face value, the law has some admirable provisions: it established improved communication regarding vaccines across all Department of Health and Human Service agencies; required health care providers who administer vaccines to provide a vaccine information statement to the person getting the vaccine or his or her guardian; and established a committee from the Institute of Medicine to review the literature on vaccine reactions.

Dig a little deeper, however, and the NCVIA does less to protect patients than it does drug companies making vaccines. When Reagan signed the NCVIA, he also created the National Vaccine Injury Compensation Program (VICP), which allows anyone—children and adults—who have suffered an injury (or worse) following a vaccination to file a claim. To date, it has paid out nearly $4 billion in compensation since 1988, including the 2008 case of Hannah Poling, whose family received more than $1.5 million in the first-ever court award for a vaccine-autism claim.

While this might sound like a good thing, one must read between the lines. The NCVIA also sets limits on the liability of vaccine manufacturers. They don’t have to pay a dime, in most cases, if someone is injured as a result of a product they make. Is there any other industry afforded such immunity? The pharmaceutical industry makes billions of dollars annually producing, promoting, and injecting a product that is known to injure people in myriad ways, and bears zero responsibility when a child—or an adult—suffers as a result.

The system is broken, and it’s why the founders of the nonprofit National Vaccine Information Center (NVIC), which worked with Congress in the 1980s to get the NCVIA passed, began calling in 2015 for its repeal. In a press release, NVIC co-founder Barbara Loe Fisher noted that the federal vaccine injury compensation program has become “a drug company stockholder’s dream and a parent’s worst nightmare.” In the same document, co-founder Kathi Williams argues that the provisions that their organization helped secure in the law are not being enforced, and most children getting government-recommended vaccines are denied vaccine injury compensation.

I don't believe it was 1 out of 10,000. I think it was 1 out of 300. Barbara Fisher and Coulter thought so.

There was enough that vaccine manufactures were going to go under financially from law suits. .

At least there were enough people around that Congress held one of those useless Congressional hearings. You know the drill by now; they get all the evil doers in the room, put the camera on them, Senators grill and tongue lash the evil doers, the public eats it up, and then--- and then---- they all go on, going on as if there was no Congressional hearing. Except in this case Congress took the right to sue away and we all thought that our government would be kind and generous.

When you watched the IACC meetings didn't you just want to choke the living daylights out of some of the people running it? I think those meetings just rub salt in t parent's wounds. It would have been more kind emotionally to parents to have had nothing. And goodness knows they did not accomplish anything either.

You're right -there is a difference between combating autism and caring about autism. The change in name to the Autism Cares Act was due to pressure from the neurodiversity community. After all, autism isn't something one needs to combat. The very concept of combating autism is insulting to autistic people...or so the rhetoric from NDers goes.

And I agreed at the time (and even more so now) with Dr. Rimland's criticisms of the Combating Autism Act. And the Autism Cares Act, especially with the IACC being dominated by non-cure advocates, is even worse. It seems that in the last two decades most major autism organizations have either been co-opted by Pharma or neurodiversity. Maybe both.

You are right .. it was George Bush who signed into law the Combat Autism Act in 2006 .. and at that time I was supporting Dr. Bernard Rimland in his opposition to the CAA .. which he expressed in the following statement:

'The fear that failure to pass the CAA will lead to a catastrophic failure to fund future autism research vastly overestimates the value of government funded research. Most such research is only of academic interest, which gathers dust on library shelves and advances the "publish or perish" aspirations of academic researchers. Is there any evidence whatever that more than a miniscule percent of government funded research has produced any positive and useful benefits for autistic children and their families, or ever will?"

As I recall events .. the Combat Autism Act made clear they had no intention to pursue environmental research .. such as ... specifically researching increased vaccines as a possible contributing factor in the inexplicable .. dramatic increase in autism. Indeed, the research they intended to pursue was exactly as Dr Rimland believed it to be .. that being of limited "academic interest" which would gather dust on library shelves.

If memory serves me right .. both Autism Speaks .. founded in 2005 .. and .. the National Autism Association .. founded in 2003 .. strongly urged passage of the Combat Autism Act.

I think the Combat Autism Act was renewed in 2015 and is now called the Autism Cares Act. It must be me .. but .. words have meaning .. and there is a world of difference between Combatting autism .. and .. caring about it.

Again, I concur! Partial-truths and insufficient measures are not what is needed, and only serve to extend and worsen matters, including to perpetuate the vaccine propaganda. Such strategies give people reason to believe that vaccines are safe and can be made safer, are effective and can be made more effective, are needed and should be mandated and increased in number...none of which is going to stop this Vaccine Holocaust.

At every opportunity, those truly wanting to stop and permanently end this Vaccine Holocaust affecting all of humanity will: speak the whole truth, not selective parts; will demand medical choice freedom and the immediate cessation of any type of mandated, coerced, required, or forced medicine; will demand that liability remain with its rightful owners, not parents and taxpayers; and will demand the immediate recall and cessation of all vaccine products. Anything less should not be accepted, condoned, or supported.

The Combating Autism Act of 2006, Pub. Law No. 109-416, is an Act of the United States Congress (Senate Bill 843) that was signed into law by President George W. Bush on December 19, 2006.

In the late 80's, when the NVICA was signed, autism was really rare (our pediatric neurologist told us our son was 1 in 10,000 in 1994 when he was diagnosed.) The only autism organizations I remember from that time are the Autism Society of America and Autism Research Institute (Bernie Rimland's organization). Neither had a lot of political or public clout.

I might add that it was not my intention to blame Reagan, Fisher, or anyone else, especially those who have worked hard in our movement.

But here is the pattern I see. Every so often, there is enough public concern about vaccine safety to force some type of action to be taken. In the case of the NCVIA, the action taken made matters worse. The alarm about the mercury content in vaccines induced vaccine makers to remove most of the mercury in the childhood vaccines in 2001. While that concern was well-justified, this action did not really resolve the overall problem and it probably took a lot of the heat off of the vaccine proponents, who could pat themselves on the back for being proactive while at the same time not admitting that mercury was causing harm.

This history tells me that our opportunities to make major changes may not come along very often and that we need to make sure that we are getting at the root of the problem rather than addressing only part of it.

What's more, we need to make sure that we are conveying the right message to others while pursuing our agenda. If our message is confusing or halfhearted, then it won't educate people and will never generate the kind of support we need to bring about the abolition of the government vaccine program.

Thank you for your continued stating of the truth, including that government vaccine programs need to be abolished.

There are so many on "our" side who continue to focus on that which will not solve the problem, such as: removing the mercury, doing more vaccine "safety" studies, making "safer" vaccines, promoting a "safer" schedule of administration including the delaying and spreading out of vaccines, reforming/revamping VAERS and the VICP, protecting and expanding exemptions, removing conflicts of interest, etc.

NONE of those is enough or acceptable. The first order of business, without fail, must be a permanent ban on any and all medical mandates, including vaccine mandates. Medicine cannot be mandated in a "free society". Mandating medicine can never be ethical. And, there can be no informed consent when medicine is mandated. Exemptions are not an acceptable solution, either, and their existence ensures they will always be under attack. A simple "no thank you" must always suffice when one wants to decline or refuse any medical treatment or procedure for oneself or one's child, without any government interference, coercion, cost, or penalty. We must demand and accept nothing less than the full restoration of an individual's and a parent's right to make any and all medical decisions, including vaccination decisions. Period.

Furthermore, at this point in time, vaccines should actually be eliminated/prohibited, as not one has ever been properly or adequately tested, nor have the myriad and haphazard combinations in which they are regularly administered ever been properly and adequately tested. Each vaccine has been prematurely and wrongly approved. None has been properly monitored. None should ever have come to market. Period.

Lastly, it should go without saying that the 1986 NCVIA needs to be immediately repealed. No industry should be given immunity from liability for the products it produces, nor should those who administer medical treatments and procedures be given immunity from liability. Period.

For those who argue that an immediate moratorium on vaccines is too drastic, not doable, or not needed, ask yourself the following:

Would it be okay to leave any other product on the market, medical or otherwise, that is destroying the lives of 6,000,000 people (and their families) per year? That number is the recent statistic given by WMP, using the figure that only 1% of adverse reactions to vaccines is reported. Given that the injection of known neurotoxins, carcinogens, immune-and-nervous-system destroyers, allergens, teratogens, and poisons causes harm and premature death to every recipient makes the statistic of 6,000,000 a gross underestimate.

The solution to the ever-growing problem known as the Vaccine Holocaust is simple:

No more vaccines. Period.

I really can't blame Reagan for signing the "Combat Autism Act" legislation .. as I said previously .. the Combat Autism Act was supported by EVERY major autism advocate organization in the country .. as all thought it would do what it promised to do .. make it easier for parents to be compensated for their vaccine injured children .. in a "non-adversarial" process.

Politically speaking .. Ronald Reagan would have been savaged by those major autism advocacy organizations had he NOT signed legislation supposedly designed to COMBAT AUTISM.

As for my own experience opposing the CAA .. I agreed with Dr Rimland who correctly perceived the Combat Autism Act should have been named the "Pretend to Combat Autism Act" .. and .. I had expressed my opinion to those major autism advocacy organization to simple re-name the bill by changing the name from "Combat Autism Act" .. to the "Autism Awareness Act" would have been more appropriate as to what the act was seeking to accomplish.

Well maybe the Lancet will; If civilization is still around.


Back in; I don't know the late 70s; they said aluminium was the cause of Alzheimer. 60 minutes did a segment of an old couple fighting that disease. She would not cook with aluminium, did not use baking powder, she was trying to save her husband with all her being.

Then we had this big long stretch of - it is not the aluminium, it is just these pesky tangles of ----what ever in the brain. We don't know what causes it, genetics probably.

Meanwhile some time after 2008, they have some secret meeting down in Puerto Rico about aluminum. It is like - it is the first time they even thought of aluminium?

Now all at once we have some expert telling us that a 15 year old's brain had a high count of aluminium, as high as an elderly Alzheimer's patient.

Wait - what? They have measured and found aluminium in Alzheimer's patients? I mean never mind the autism brain, how long have they known about the Alzheimer;s brains?

Yes. I too love that quote by Reagan. Ironic that he was the one who signed the NVCIA. Pundits and historians love to debate what each of the president's "legacy" is. Of course, when doing so they need to decide how to assess such a thing, which initiatives to emphasize, etc. I have never seen such an individual even consider Reagan's signing of NVCIA when trying to evaluate him, but that may be the single most consequential action he took, when all is said and done.

To be clear, I agree that the NVCIA has made things worse, but the government vaccine programs were causing mayhem a long time before it was implemented. Just as government-sanctioned chattel slavery needed to be abolished, the government vaccine programs need to go. Trying to reform them is akin to our ancestors trying to implement regulations demanding that slave owners treat their slaves a little better, maybe giving them a day off every now and then. It is no way to combat evil.

As a self-identified senior citizen .. who has lived long enough to have witnessed DECADES of "government programs" that are a "menace to the people" .. I strongly agree with you .. and .. also with Ronald Reagan who said: "The nine most terrifying words in the English language are: I'm from the government and I'm here to help".

Unfortunately .. in my advanced lifetime.. I have learned that government is more "problem" .. than "solution".

At the end of the day, laws and constitutions alone cannot produce just outcomes, since they are implemented by fallible people. If they are misinterpreted by judges, wielded for political purposes by prosecutors or misapplied by bureaucrats or administrative courts, then they will be detrimental.

Let us not deceive ourselves into thinking that the government vaccine programs can EVER be reformed in such a way that they will be anything but a menace to the people.

They need to be abolished and this has become abundantly clear. We should not tolerate anything less.

My friend .. I would respectfully disagree.

As I see it .. it is not the "laws of our country" that are failing us .. it is the PEOPLE we have elected .. and .. even more so .. those entrenched UNELECTED AND APPOINTED .. who have abused those laws in order to "benefit certain favored groups (THEMSELVES) .. and .. to disadvantage other groups lacking political power".

Consider .. way back when Dr. Bernard Rimland was shamefully attacked by major autism organizations for challenging the 'COMBAT AUTISM ACT" .. under which the NVCIA was enacted .. because he stated the legislation should have been named the "Pretend Combat Autism Act".

Dr Rimland's comments should be read in full .. having written the following beginning sentences:

"I strongly oppose endorsing "The (Pretending to) Combat Autism Act" unless it includes clear and explicit language supporting meaningful research on the role of vaccines and mercury as plausible causes of the autism epidemic ......... the proposed Combating Autism legislation is as sincerely dedicated to combating autism as O.J. Simpson was to finding the "real killers" of his ex-wife Nicole.

My point being .. Dr Rimland's correct assessment of the flaws in the supposed "Combat Autism Act" have proven he was CORRECT ... but .. none-the-less ... Dr Rimland was shamefully attacked .. by most major autism organizations of the time .. for opposing ANY legislation "designed" to COMBAT AUTISM.

I would only suggest that politicians and their corrupt colleagues who prosper and dwell within that DAMNED SWAMP .. are not stupid .. they will NAME legislation in such a way that opposing it makes it extremely difficult to over-come .. such as .. the PATRIOT ACT .. which has diminished our Constitutional Rights to "due process and privacy".

Only now .. 15 years removed from 9/11 .. are we beginning to learn how the PATRIOT ACT has empowered the DEEP STATE to invade our lives.

Correcting myself .
The governments of Japan has withdrawn both the MMR & Gardasil .
And Sweden rejected mandatory vaccination when it came down to it.

So there is some honour left in the world . Just not in the world I inhabit .

This article lost me at the 1st sentence. The laws of a country SHOULD BE designed to protect its citizens. But the reality is that many, if not most of them are designed to benefit certain favored groups and/or to disadvantage other groups lacking political power.

Sure, the politicians cannot be honest about their intentions and expect their bills to pass. So they must concoct some kind of cover story about how their proposal is being done to protect people and for purely righteous reasons. But the cover story and the reality are 2 very different things and the NCVIA is no exception. Even if some of its provisions may have looked good on paper, the reality is that it was going to be implemented by a corrupt government which could not care less about the children (their rhetoric notwithstanding) or the parents of the vaccine injured.


I love "HighWire" Mr. Bigtree interviewed Katie Wright the other day. She gave the listeners the story of her family's journey in this huge saga of the Age of Autism.

That might be a great book; A chapter featuring a short story of the leaders of this vaccine injury movement. The template could be the story of how their child was injured (or if not injured what made them aware!) and then what they did about it; how others reacted to it - what they accomplished.

Anyway; Katie Wright said that her Dad did not really believe her ; about the vaccine injury however; he wanted to help regardless. He went down to talk to the CDC people. What he found was a bunch of people that did not care. She said their attitude was; we don't have to worry about vaccine injuries cause no one can be sued or held accountable. It was just not important to them at all that their policies were harming so many children just because no one could be held accountable.

Who knew; that federal agencies are full of pigs! I did not know there was that many pigs in the United States let alone enough to randomly fill up a government agency.

Now there is a story to shake anyone's faith that man kind will some day become this great entity that will own the stars, and there won't be some war ending civilization. It makes you look at the Bible as a real prophesying book that tells us there would be not one human being left if Jesus does not come back. Geesh.

What other product has the full and unquestioning support of all governments ?

The USCFC is bound in the NVICP by a 36 month Statute of Limitations. No tolling for minors nor the "incompetent". If such a rule were enacted by a State Court, barring a minor, the SCOTUS would assuredly hold it to be a violation of the due process clause of our Constitution. Instead, the Supremes have refused to hear such appeals when they have come up. Who knows how many tens of thousands of would be petitioners have been advised by attorneys not to bother to fill a claim? Is there a single person or family out there who does not have or know a neurologically injured person that were emergent beyond 36 months of life?
The sad truth is that the society actually thinks that the greater good is served by vaccines. They are not even paying attention any more. Capitalism has hung itself with it's own made rope. As foretold.

The correct answer to Deirdre's rhetorical question .. is a LOUD .. resounding .. NO.

I would suggest that "repealing and replacing" the NCVIA ought to be priority NUMBER ONE .. for Congress and our President .. now that they have more or less failed in their attempt to "repeal and replace the Affordable Care Act".

I admit to being torn between what I want for Christmas this coming year ..

#1 .. Replacing and repealing the NCVIA ..

#2 .. Creating that independent Commission to investigate the "safety and efficiency" of our vaccines and the policies by which they are recommended, approved, administered .. with special attention given to how adverse events are "reported"

#3 .. Conducting that long-over-due independent study of vaccinated v. unvaccinated populations .. to ascertain if BOTH populations have suffered the same .. inexplicable .. increase in chronic autoimmune disorders that were far less common in all PREVIOUS .. LESS VACCINATED .. GENERATIONS.

Unfortunately .. it is not up to SANTA to grant me my wishes .. instead .. only Congress and our President have the power to grant me my wishes .. which means .. if history is my guide .. I WILL BE GETTING NOTHING .. AGAIN .. FOR CHRISTMAS THIS YEAR.
