Attorney Challenges Letter By AAP's Tayloe on Children's Vaccine Injury Lawsuits

I am Robert J. Krakow. I am the parent of a 9 year old boy who has a vaccine injury claim. I am also a former prosecutor (1980's) and a  trial lawyer, who now spends much of his professional time engaged in vaccine injury litigation and related issues.

My letter (below) to Dr. Tayloe, President of The American Academy of Pediatrics, is intended to challenge his misrepresentation of the AAP's position supporting the vaccine industry on an important legal issue. The only parties for whom the vaccine court is working as intended are the vaccine manufacturers. In the last 20 years or so since the Vaccine Injury Compensation Program was implemented the vaccine sector of the pharmaceutical industry has flourished. At the same time children have been frustrated in their struggle for  justice and redress for serious vaccine injuries. The Ferraris followed the rules, but now the vaccine manufacturers, supported by the AAP, want to change the rules 23 years after enactment. The letter explains the rest.

Dear Dr. Tayloe:

Your “Letter from the President”1 published in the May edition of the American Academy of Pediatrics’ (“AAP”) newsletter misleads readers regarding the AAP’s position on children’s vaccine injury lawsuits. [Editor's Note, read the newsletter HERE] The AAP has taken a pro-industry position adverse to the rights of injured children in its amicus curiae brief submitted to the Supreme Court of the United States in American Home Products Corporation, dba Wyeth, et al., v. Ferrari, et al., No. 08-1120.

You state that,

The Academy is writing an amicus brief for the U.S. Supreme Court concerning a vaccine-related injury lawsuit in Georgia that is being brought by plaintiffs in state court prior to a final ruling by the VICP on the merits of their claim. The viability of the VICP could be in jeopardy if the manufacturer is not successful in this case. The VICP must remain the first contact for all alleged vaccine-related injuries before plaintiffs are allowed to pursue legal action in civil court. Rolling the clock back to the early 1980s when many vaccine manufacturers exited the market secondary to massive vaccine-related injury lawsuits would significantly undermine our already fragile childhood immunization program. (Emphasis added).

Your statement misconstrues the issues presented in the case and utterly misrepresents the position taken by the AAP in its amicus brief.

As clearly set forth in Wyeth’s brief, which the AAP explicitly endorses, the Ferraris fully complied with the requirements of the Vaccine Injury Compensation Program (“VICP” or “vaccine court”) by filing their claim with VICP in the first instance before exercising their legal right to withdraw their vaccine court claim. The Ferraris then pursued their claim in the Georgia state trial courts. The Ferraris properly made the vaccine court their “first contact” in pursuing their claim that vaccines neurologically injured their infant son. Your suggestion to the contrary is factually incorrect.

Your statement shows that you fail to understand that the 1986 tort reform enactment was designed to protect vaccine manufacturers.

Congress implemented a statutory scheme that required a vaccine injury claimant to first file his or her claim in the vaccine court. Congress explicitly permitted the claimant to remove the claim from the VICP so that the claim could be pursued in traditional tort forums. In no way does the Georgia Supreme Court decision in Ferrari represent a “rolling the clock back to the early 1980’s”, as you suggest. Instead it affirms the statutory scheme contemplated by Congress to address the perceived problems with the nation’s vaccine program.

The position advocated by the AAP and its allies in the medical industry in support of Wyeth and the pharmaceutical industry is that the vaccine court should be the only remedy for vaccine-injured children. The AAP supports a prohibition of all design defect claims in civil courts, effectively limiting injured children to a remedy in the vaccine court. In addition to the explicit preemption of “failure to warn” claims already contained in the National Childhood Vaccine Injury Act, this would provide virtual complete immunity for all vaccine manufacturers. At the same time caps on damages, elimination of jury trials, and severe limits on discovery of vaccine industry information, among other legal limitations of the VICP, restrict the rights of vaccine-injured children. Under the position you promote, the VICP program would be the only legal option for vaccine-injured children, not merely their “first contact.”

Contrary to your assertion, the 1986 tort reform provision known as VICP has served to permit the vaccine industry to flourish; vaccines have become a major pharmaceutical industry profit sector with the introduction of financial “blockbuster” vaccines like Wyeth’s Prevnar and Merck’s Gardasil.2 Indeed, your own AAP amicus brief asserts that the VICP has been a success, verifying that “[v]accine development has flourished since 1986 with the number of vaccine-preventable diseases having more than doubled.”3

The AAP has requested the Supreme Court to erect a complete bar to vaccine injury lawsuits against manufacturers. This ignores the well-founded concern, articulated by the Georgia Supreme Court in Ferrari, that such a bar would leave an inadequate check on vaccine maker actions to insure safety for children for whom vaccination is mandatory.4 The need for such draconian restriction of legal rights of children is dubious; your suggestion that the nation’s childhood vaccine program is “fragile” is belied by historically high vaccination rates and mandates requiring more vaccines than ever before.5

The misrepresentations you have made in your letter suggest that the AAP is incapable of understanding the legal policy stance it has so vocally promoted. It is troubling that the AAP would adopt a position that would so completely – and unnecessarily – limit a vaccine-injured child’s access to justice.

Ironically, the position taken by the AAP in the Supreme Court affirms the societal/legal judgment, reflected in the multiple judicial opinions, that vaccines are “unavoidably unsafe” and, when properly prepared, cannot be made safe.6 In light of this damning judgment of vaccine safety, the AAP places priority on protecting vaccine manufacturers rather than protecting the safety of children from an “unavoidably unsafe” intervention. It would better serve our children and the nation’s vaccine program if the AAP would focus on making vaccines safer rather than protecting manufacturers from the legal perils of vaccine dangers.

The AAP’s position is not one that inspires parents’ confidence in our nation’s vaccine program. Parents must make individual choices that affect the health of their precious children. In light of the AAP’s position in the Ferrari case – placing greater value on vaccine maker interests than children’s safety – there exists profound doubt whether the AAP truly adheres to the legend that appears on its website, proclaiming that the AAP is “Dedicated to the Health of All Children.”

My grandson,Francis Xaiver Rawnsley,died March 14,2008. He was a beautiful and healthy baby boy. He was only four months old. He only weighed fourteen pounds and he was vaccinated and he was administered eight different vaccines. He died twelve hours after he received these shots and his medical historical overview was very short lived. (SIDS) The sudden death of an infant baby was very difficult for this family to accept and the mother of this baby is a nurse and she is in remarkable health. I did research into twenty years of excuses from so many organizations that support (SIDS) and reports data but ignores information that I feel is relevant and attributed to the death of Francis.The moment I walked into my son's home and saw firemen and ambulance workers and saw my son and daughter in law in such grief, I knew something was so very wrong. I saw Francis a few days earlier and my daughter in law was questioning the need to vaccinate Francis. He was at no risk. I was not aware of the scheduling practices and I feel that we failed to protect Francis and my heart aches to know we should have made some different choices. I read of one clinic and five or six deaths of infants within one small time frame. I contacted the state medical examiner office and the people in that office were not very helpful and you never read of any concerns in the news media.

Doctors are in denial.My grandson's death was reported to the vaccination injury program but I'm not sure why they take so long to review such a small medical file. The entire process is not very dignified and the family has emotional trauma that is never taken into consideration by this program. I have to wonder how some of our politicians sleep at night.

My daughter in law"s mother carried a picture of Francis;along with the date he died and was vaccinated to a rally in Washington last year.A picture does speak a thousand words.Jenny McCarthy has brought some of the seriousness of our concerns to the forefront but we need more parents to come forward and we need the support of the news media. We can't make any differences if we are able to bury our heads in the sand for the sake of the almighty dollar. Our children can not become the lost soldiers in this battle. We have too many children already in harms way.

My daughter in law should be contacted. If you wish to speak with her you should contact her and ask her to forward you the letter that she submitted to the Governor of N.H. Kathy it is called SSI and my 23 year old son will be very lucky to get it! My son's lawyer told me that a dignosis of autism use to be a given in getting SSI,but not anymore. We have been trying for a year and a half now. Keep all records, get it all together and organize it to the point of being obsessive. Make sure you have a detailed index page. If you get the packet from the vaccine court telling you how to sue the secretary of health- yourself (hee-hee),use that as an example to get your papers together for SSI. You should type up all the names and addresses of all the doctors, hospitals, emergency visits to where ever, or anywhere there has ever been a test done including any psy or speech, testing and don't forget the schools - they will be your best friends when the time comes. GO through your baby pictures on up to the most recent pictures, and make a collage to go with it all. Make sure you have FOUR copies of all this (you can never really have enough copies). Put it all in some type of bound note book. You will have to try three times, they will give you nothing the first two times (everybody says so). On the third try- now go and get a lawyer give her/Him all your papers and pictures that also explains in short everything that has happened. Make sure to include in those papers you give the lawyer the recent psy- evlauation that the government paid for you to get during the second try. You will have to call several places and be very nice and beg for them to send it. Mr. Krakow thanks for the letter that is the only justice my son will ever receive- but it is better than nothing.It did me some good, I know it made Tayloe squim some if he is even a little bit human. To bad we can't waterboard US citizens because some people really need it.

Thank you for calling the AAP on their lack of concern for our children...who are supposedly the reason they exist. Just because they have stolen their voices doesn't mean they will go unheard. This makes me MAD!!

I try not to be bitter about what has happened to my child as it will serve no good purpose. Still there are days when I see her struggle.....I wish Tayloe and his pharma cronies could feel a fraction of the misery rained down upon the children and families affected by vaccine injury....the crushing fear, heartbreak and abject misery.

I think it's high time they extend all statutes of limitations, and every parent who has proof of vaccination and autism resulting, should have the RIGHT to sue. ARe you in on this at all? Because if you are, I want to persue this idea further...I want to know why I have to be excluded when my son still suffers, my daughter as well? Where is my justice? Have proof of reactions within eleven days of DPT, and for my daughter two weeks, which resulted in declines, seizures, ear infections after another, immune destablization, etc. Have high mercury loads, viral loads, mitochondrial collapse, seizures, etc. Again, where are all the adults with autism and their families, which may require lifetime money and supports for their children?

I don't think focusing on the looks of Dr. Tayloe do anything but distract from the arguments at hand. And indeed seem a bit unseemly. I would assume it would just fuel the arguments of your opponents to claim such comments are from crackpots and kooks and represent the vast majority of anti-vaccine work. At least I read this page. The article seemed well done until I got into the comments. The comments were stupid sorry to say. That is what I will remember from the page. The poor commenting.

When I saw Mr Tayloe on Larry king I knew he had no interest in putting children first.I watched this man look at the other guest as if they had two heads when they mentioned vaccine adverse reactions,as if he had never heard of such a thing. He was very clever to say Not in my practice. Fact is tayloe's father had fried a childs brain by readministering a vaccine the child had already adversely reacted to. His dis ingenuous conduct told me exactly what kind of man Tayloe jr is. Dishonest.

The AAP's response to autism spectrum disorders can be described as pathetic at best. This organization is clearly not interested in determining the underlying cause(s) of ASD, nor the biological pathologies let alone recognizing promising treatments or best practices. Their position regarding vaccines is compromised as a professional organization as they accept funding from pharmaceutical companies. How can parents or health professionals trust that their positions are unbiased?

Thank you, Robert, for speaking so well for all of us. Many of us lack a full understanding of the laws surrounding "vaccine court" and injury "compensation" and it's extremely important that we all be made to comprehend these things to create consensus. I'd been hoping for an explanation of the "amicus briefing war" over the Farari case in Georgia. I hope that you'll be writing more about this.

I'm sorry if this offends anyone on our side, but I have a recurring thought every time I read about industry's blockading of justice in the case of vaccine injuries. I just can't see how unregulated vaccines and resulting injuries are much different than turning some children-- or, in most cases, just parts of them (like pieces of their brains and kidneys, a few yards of GI tract, their nervous systems)-- into lampshades and soap. I think that when loyal-AAP members look at, say, the candles on the Tiki bar of some industry hosted event or one of their swank conventions, they should have visions of a few baby teeth and tiny fingernails lodged in the wax. I think the leather interiors of their new BMWs and the buttons on each other's cashmere sports jackets should give them sudden nausea.

In terms of body count, direct intent of all involved and the speed with which this is happening, maybe the comparison is not there yet but, in terms of outcome and how history will look back on this period one day, there's a trajectory which is recognizable. I believe the industry rationale that this is "happening" to some children because of "genetic inferiority"-- and the propaganda campaign to make the public believe the same-- makes the comparison hard to ignore. I don't think those responsible should be spared the suffocating shame of it.

Maybe a less shocking analogy is the era of child labor in the U.S. Not a stretch-- our children's bodies are used as profitable receptacles for all kinds of chemicals and if the child falls into the industrial loom or is crushed in a mine shaft, we're sent to stand in front of the company store to beg for some bandages or a coffin.

I suppose that analogy fits better because the AAP, like industrialists in 1912, can pretend that all children benefit from the 40 cents a day they were paid for the exploitation, just like families today are supposed to be grateful for the sometimes dubious "full immunity" provided by some of the shots in exchange for the causualties. But I have to say, my mind keeps going back to soap and buttons.

When does it end? When the national rate is 1/28 or more?

David Tayloe talks more like the president of the doctors' union than the head of an organization "dedicated to the health, safety and well-being of infants, children, adolescents and young adults," as they state in their mission statement. I'm sure the vaccine makers are happy with his position denying any serious side effects from their products, no matter how many parents report that their normally progressing children regressed into autism following routine vaccinations.

The AAP is waging an all-out war against those activists who claim vaccines have damaging side effects and against any parent trying to receive compensation for a vaccine injury.

Part of their strategy is to pretend that autism hasn't increased. According to the AAP, there is only an "apparent increase in autism" which may be due to a combination of factors such as an expanded definition of the disorder and the fact that "the public and the medical profession recognize these disorders more often."

For parents worried that all the kids everywhere with autism might mean their child could be next, the only thing the AAP can tell them is that autism "has a strong genetic basis" and that "the cause or causes of autism are not known."

Despite claiming that better diagnosing is the reason for the explosion in autism, the AAP had to give out a list of the signs for doctors to look for at well baby checks at their San Francisco Conference in 2007 in order to diagnose autism sooner.

The AAP adamantly denies a link to vaccines; all the studies say vaccines don't cause autism. And despite the Vaccine Court concession made in the Hannah Poling case, the AAP cites the United Mitochondrial Disease Foundation, saying "The UMDF cannot confirm any association between mitochondrial diseases and vaccines."

It's hard to find anything doctors can tell parents about autism except to deny that vaccines are involved. The AAP slams complementary and alternative medicine (CAM) saying that especially chelation and hyperbaric oxygen are "neither safe nor effective as autism treatment" and there is "little evidence to support or refute" the efficacy of the gluten-free/casein-free diet.

The AAP has little concern about the outdated autism rate showing one in every 150 kids has the disorder. It's hard to imagine how bad the numbers would have to get before the Academy would stop talking about the "Mystery of Autism"

and actually call autism a health care crisis that we need to address as an emergency.

One thing is certain: The AAP can be counted to be the strongest supporters of the vaccine industry. And why not? What would a well-baby check be like without the lineup of shots every time a visit is scheduled?

Tayloe will slink away with his tail between his legs. I am forwarding this on to EVERYONE I know. Every board I'm on, every blog I write on. I want everyone to know that the Peds of this nation are being told to not only side with the vaccine makers but that the all knowing and great AAP isn't watching out for their children. They are not taking care of children, they are wiping the asses of the pharma industry.
Every mom and dad needs to know that Tayloe is sending this out to the very Peds that they think/say they can trust.
This is just a sick and abusive use of power on the part of the AAP and Tayloe.

Another Tayloe whopper occurred on Larry King Live when he stated pediatricians "lose money" on vaccines in their office practice. On the contrary, 1/3 of practice income is derived from well-baby care as a result of vaccine protocols. Jenny McCarthy's doctor characterized Tayloe as "disingenuous", politely calling him a liar. Isn't there some penalty for lying an a national broadcast to purposely mislead American parents?

Why would parents visit a pediatrician 4-5 times with a healthy baby if not for the vaccine assembly line? How will pediatricians come up with 30% of their income if vaccine revenue vanishes? There you will find the root of the AAP's "concerns".
